The former personal attorney for Donald Trump has stepped down as New Jersey's top federal prosecutor. This follows a legal ruling that challenged her legal standing to serve.
Acceptance of Resignation
The nation's top law enforcement official, the Attorney General, confirmed her stepping down on the start of the week. She commented that the judicial decision made it impossible for the official to lead the department effectively.
"Do not interpret adherence to the ruling as defeat," Habba stated. "The effort will now extend throughout the country."
Judicial Challenge
Her resignation was triggered by a federal appellate panel found that she had been acting without proper authority as US attorney. This decision is expected to impact many prosecutions in the state.
The court ruled that a interim role that did not receive the advice and consent of the Senate breached the statute on vacant positions.
Next Steps and Responses
It was also stated that the former prosecutor will continue working within the DOJ as a high-level advisor. Habba plans to pursue additional appeals of the disqualification, in the hope of achieving a different outcome.
In a statement, she argued that the judiciary "should not be able to second-guess the President's choice of lawyers responsible for carrying out the primary duty of the administration of enforcing the law."
Performance in Office
Bondi highlighted Habba's record and noted that under her leadership, the state capital of Newark saw a significant drop in offenses. She also stated that the city of Camden had its first summer in 50 years free from homicides.
Legal Career
The 41-year-old attorney, originally became part of the former president's legal defense in recent years. She went on to represented Trump in his New York criminal case in New York last year, when he was conviction on 34 counts of financial record manipulation.
Earlier, Habba took on the federal prosecutor position, Trump had revealed he was naming her as his presidential counsellor in a potential future term, calling her as "unwavering in her loyalty" and a dedicated fighter for justice.
