The NBA legend Tells Court He Felt No Fear of the Racing Body in Legal Battle
Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, stated that his drive to win and status as a newcomer emboldened his push for 23XI Racing to confront Nascar over alleged violations of antitrust rules.
Team Investment and a Competitive Drive
The owner disclosed financial and corporate details of his 23XI team, revealing he put in $40m of his personal wealth into the Cup Series operation launched with business partner Curtis Polk and driver Hamlin.
“Someone had to step forward,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar in its entirety. I felt as far as the sport required examination from a different view.”
Central Issue: Franchise System and Contract Pressure
The heart of the case involves the end of a 2016 deal where Nascar provided each team a franchise. The concept is similar to other major leagues with independent franchises, such as the Charlotte Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar insisted on teams renew their charters.
Jordan was on the witness stand for an hour and exited the courthouse to pandemonium, with onlookers and reporters vying for a glimpse or a picture of the global icon.
Spearheading the Fight
23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a business model Jordan contended is breaking the law to maintain excessive control.
For Jordan and and Heather Gibbs, who testified before Jordan, are details from last September. She recounted a frantic and emotional six hours where the racing circuit informed teams they had to sign a contract extension. The document spanned over a hundred pages outlining team compensation and a guaranteed entry in Nascar-sponsored races.
A Refusal to Sign
Jordan explained that his team and its ally decided their sole viable path was to decline to sign that 112-page package and take the issue to court. All other teams agreed to the terms.
The team owners approached Nascar about possible changes or negotiations. Nascar wasn’t talking, Jordan said.
The Ultimate Motivation: Winning
But in the end, the pushback against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Winning.
“Denny convinced me getting a third driver boosted our odds of winning,” he testified, noting that he purchased another franchise late in 2024 for $28m amid the legal dispute. “So I dove in.”

Heather Gibbs detailed her push for indefinite franchises, which she said a formal letter to Nascar. She testified the timing of the contract signing demand didn’t sit well.
According to her, the team founder first attempted to call and persuade Nascar against forcing signatures, but CEO Jim France declined the request.
“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s executives. The response was, “If I wake up and I have 20 charters, I have 20. If there are 30, I have 30.”
